Terms of Service

1. Agreement to these terms

These Terms of Service (“Terms”) are a binding agreement between you and adm8 AB (“adm8”, “we”, “us”), governing your access to and use of adm8.ai and the adm8 application (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be at least 16 years old (or the age of digital consent in your country) and able to form a binding contract. You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us immediately of any unauthorized use.

3. Credits, plans, and billing

The Service uses credit-based pricing for image and video generation. You can subscribe to a monthly plan or buy one-time credit top-ups.

• Credits are consumed when you generate content. Credit costs per generation are shown in-product and may change with notice.
• Subscriptions renew automatically each billing period until cancelled. You can cancel anytime via the billing portal; cancellation takes effect at the end of the current period.
• Payments are processed by Stripe. By purchasing, you authorize the applicable charges, including taxes.
• Refunds — except where required by law, fees and consumed credits are non-refundable. We may offer credit adjustments at our discretion for verified service failures.

We may change pricing prospectively; changes do not affect the period you have already paid for.

4. Acceptable use

You agree not to use the Service to create, upload, or distribute content that:

• Is illegal, infringes others’ intellectual-property or privacy rights, or violates publicity rights.
• Depicts sexual content involving minors, non-consensual sexual content, or content that sexualizes real identifiable people without consent.
• Is hateful, harassing, defamatory, or incites violence.
• Impersonates a real person or brand in a deceptive or harmful way, or creates deceptive deepfakes.
• Contains malware, attempts to breach security, scrape, reverse-engineer, or overload the Service, or circumvents usage limits or credits.

We may suspend or terminate accounts that violate this section, and we may remove content or cooperate with authorities where required.

5. Your content and ownership

You own your inputs. You retain the rights you hold in the prompts, reference images, brand assets, and other materials you provide, and you grant us a limited license to host and process them solely to operate the Service.

Output. Subject to your compliance with these Terms and the terms of the underlying AI providers, you may use the images, videos, and compositions you generate for your own commercial and non-commercial purposes. You are responsible for ensuring you have the rights to any inputs you provide and for how you use the outputs.

Because of how generative models work, similar or identical outputs may be produced for other users; we make no exclusivity guarantee over generated content.

6. Third-party services

The Service relies on third-party providers (for AI generation, hosting, payments, email, video delivery, and analytics). Your use of the Service may also be subject to their terms. We are not responsible for third-party services and may change providers over time.

7. Intellectual property in the Service

The Service itself — including the software, design, branding, and the adm8 name and logo — is owned by adm8 AB and protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or to copy, modify, or create derivative works of the Service.

8. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy of generated output, or uninterrupted availability. AI output may be inaccurate, offensive, or unexpected; you are responsible for reviewing it before use. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

9. Limitation of liability

To the maximum extent permitted by law, adm8 AB will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnity

You agree to indemnify and hold harmless adm8 AB from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms or of any third-party rights.

11. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (e.g. ownership, disclaimers, liability, governing law) will survive.

12. Governing law and disputes

These Terms are governed by the laws of Sweden, without regard to conflict-of-laws rules. The courts of Stockholm, Sweden have exclusive jurisdiction over disputes, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings locally.

13. Changes to these terms

We may update these Terms from time to time. We will post the updated version here with a new “last updated” date and, for material changes, provide additional notice. Continued use of the Service after an update means you accept the revised Terms.
